- facts: The client arranged a deal with a local gas station to detail cars in their parking lot in West Tampa. At some point a co-defendant became involved in a verbal altercation with someone at the gas station. The verbal altercation escalated out of control, and the co-defendant grabbed his firearm when he saw one of the victims reach into his vehicle. This caused everyone to scatter. Despite the fact that the co-defendant did not have a close relationship with the client, the co-defendant jumped into our client's car and began to fire his pistol in the air. Tampa Police began an investigation into the incident, and was able to locate our client with very little effort. When confronted with the detective the client refused to talk. He evetually told his father about the criminal investigation and our office was retained. At the time our office was retained the client had been contacted by law enforcement twice. Once while he was alone, and another time in the presence of his father. Merely pointing a firearm at someone can carry a minimum/mandatory sentence of 3 years in Florida State Prison (it could carry an even harsher sentence if the facts warranted a charge under the 10-20-life statute). When law enforcement contacted our client they pointed out that he could go to prison for assisting in the commision of the crime if he refused to cooperate with them.
- defense: This case emphasizes the importance of retaining defense counsel as quickly as possible. It is impossible for a criminal suspect to address law enforcement without running the risk of offering evidence against himself. A confession, or an admission to a crime is obviously very incriminating evidence. A suspect could easily convict himself when confronting law enforcement without counsel, or his statements could be so twisted by law enforcement that they appear incriminating when they're not. Either way the outcome is many times bad for the client. When we contacted the tampa detective we explained our client's involvement in the incident. Eventually, we were able to satisfy the detective, and our client avoided a very serious problem.
