- facts: An officer responded to notice of an unconscious male subject on the side of the road. The officer set out to look for the subject and check on his well-being. When the officer arrived, the defendant was lying on the sidewalk, unconscious on his back. The officer tried repeatedly to arouse the defendant. When he finally rose, she detected a strong smell of alcohol on the defendant's breath. The defendant did not answer the officer's requests and began walking away. The officer grabbed the client's arm in attempt to gain control over him and to sit him down. The subject pulled away and swung his arm and fist in the officer's direction in attempt to hit the officer. The defendant then continued to walk away, refusing the officer's verbal commands to stop and sit down. After ignoring additional warnings, the officer tasered the client in order to subdue him. Officers charged defendant with Obstructing or Opposing a Law Enforcement Officer with Violence, a third degree felony and Assault on a Law Enforcement Officer, a first degree misdemeanor. The defendant entered a plea of not guilty to both charges.
