Injunction for Dating Violence dismissed»

Investigation uncovers false allegations
facts: Our client (respondent) was a very successful sales representative for an insurance company. About a year after being hired he met an older woman that was well connected to some people in upper-management. They dated for a about a year and a half before the petitioner ended the relationship in a very abrupt way. The client was very surprised that the petitioner wanted to break up 24 hours after a very long sexual encounter. He didn't realize that the petitioner (older woman) had started dating another employee in upper management, and was interested in someone with more money. During the two weeks that followed the breakup the client attempted to reconcile. It wasn't until he saw the petitioner with this other man that he finally realized there was no hope of salvaging the relationship. To make sure that the respondent/client got the message the x-girlfriend/petitioner started kissing and groping the new boyfriend in a beach bar in front of the respondent and a number of other employees. Our client never threatened the petitioner during this incident. Days later the client argued with the petitioner on a number of occasions, but never threatened the petitioner.
Finally, in the beginning of April the petitioner had a birthday party in the office shared by her, our client, and a number of other employees. The new boyfriend in upper-management ordered a male stripper to dance for the petitioner. As you could imagine the male stripper's performance created a scene at the office.  Embarrassed and humiliated the client notified top management about the inappropriate behavior of his x-girlfriend, and others involved in the incident. In response, the petitioner and other relatives in the company filed an injunction against our client in an effort to ruin his career and take away his license.
The petitioner filed a petition with the Domestic Relations Court in Bartow, Florida requesting the Court to grant her an injunction against dating violence. In her injunction the petitioner exaggerated a number of different instances where the couple had argued. None of these altercations involved any violence, but that never stopped the petitioner from lying in the petition about our client's actions.
defense: After reviewing the petition we sat down with the client and explained how involved this particular case could become. Many people feel injunctions are minor hearings that involve little time on the part of a lawyer. This is a serious misconception. To properly prepare a defense to many injunctions it can take months of depositions and investigation.
The petitioner was convinced that she was going to prevail in this case because of the allegations of violence in her petition. As a result, she initially did not seek out any legal counsel. That changed after the petitioner, and her witnesses were deposed. She retained counsel who asked for a continuance in an effort to do his own depositions of our witnesses.
